Terms of Service

Welcome to ConFYI Post (the “Service”), a social-media scheduling, publishing, analytics, and team-collaboration service operated at post.con.fyi and related pages (the “Site”). These Terms of Service (the “Terms”) govern your access to and use of the Service. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The company behind this deployment

The Service is operated by Open Growth Group INC, a corporation incorporated in Delaware, USA. In these Terms, “Open Growth Group”, “we”, “us”, and “our” mean Open Growth Group INC.

This deployment uses the Postiz software and may connect to third-party social platforms. Open Growth Group INC is responsible for this deployment, your account on it, and the integrations configured for it. Open Growth Group INC is not the operator of postiz.com and is not Apple, Google, Meta, LinkedIn, TikTok, X, or any other connected platform.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of entering into a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes both you individually and that organisation.

You are responsible for maintaining the confidentiality of your credentials, for activity under your account, and for keeping account information accurate and current. Notify us promptly at hello@opengrowthgroup.co if you believe your account has been accessed without permission.

3. The Service

ConFYI Post provides tools to plan, schedule, publish, analyse, manage, and collaborate on content distributed to connected social-media and communication channels. Features, supported channels, limits, and availability may change from time to time.

We may add, remove, modify, suspend, or discontinue a feature or integration, including when a third-party platform changes, limits, or revokes API access. We will use commercially reasonable efforts to communicate material changes that adversely affect an active paid arrangement or a critical integration.

4. Commercial terms

If access to a paid plan or other commercial service is offered, the applicable order form, plan page, or written agreement controls the fees, billing cycle, renewal, cancellation, and refund terms for that purchase. Unless a separate commercial agreement says otherwise, fees are due for the selected billing period and are exclusive of taxes and government charges.

Payment information may be handled by third-party payment processors under their own terms and privacy policies. We do not need your full payment-card number to provide the Service.

5. Free, preview, and beta features

We may offer free access, trials, or features marked “beta”, “preview”, or similar. These offerings may have limits and may be modified or discontinued. To the maximum extent permitted by law, free and beta features are provided “as is” and without warranties.

6. Your content

“Your Content” means text, images, video, audio, links, metadata, schedules, prompts, configurations, and other materials that you upload to, generate within, or transmit through the Service. As between you and Open Growth Group, you retain ownership of Your Content.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, display, adapt, and distribute Your Content only as needed to operate, provide, secure, and improve the Service, including transmitting it to the third-party platforms you connect and generating previews, analytics, and related outputs.

You represent and warrant that you own, or have all permissions necessary for, Your Content; that publication through the Service does not infringe another person’s rights; and that Your Content complies with these Terms, applicable law, and the rules of every third-party platform to which it is published.

7. Acceptable use

You must not, and must not allow another person to:

  • publish, distribute, or store unlawful, defamatory, harassing, hateful, threatening, sexually exploitative, or infringing content;
  • send spam, conduct coordinated inauthentic behaviour, run undisclosed bots, manufacture fake engagement, or violate a connected platform’s rules;
  • circumvent rate limits, technical restrictions, or access controls of the Service or a connected platform;
  • reverse engineer, decompile, scrape, or attempt to derive the source code of the Service except where applicable law or an open-source licence expressly permits it;
  • resell, sublicense, white-label, or commercialise the Service except under a written agreement with Open Growth Group INC;
  • upload malware, gain unauthorised access, or interfere with the integrity or performance of the Service or its infrastructure.

We may suspend access, remove offending content, and disclose violations to an affected third-party platform where reasonably necessary or legally required.

8. Third-party platforms and integrations

The Service can publish Your Content to third-party platforms such as X, Meta platforms (Facebook, Instagram, and Threads), LinkedIn, YouTube, TikTok, Pinterest, Reddit, Bluesky, Mastodon, Discord, Slack, Telegram, and others. You authenticate those accounts and authorise the Service to act on your behalf.

Your use of a third-party platform is also governed by that platform’s terms and privacy policy. Examples include the YouTube Terms of Service and Google Privacy Policy, the X Terms, the Meta Terms, the LinkedIn User Agreement, and the TikTok Terms of Service.

You may revoke access from the Service’s account settings or directly from the connected platform’s permissions page. Revocation stops future actions that require that authorisation, but may not undo content already published or data already processed by the third-party platform.

We are not responsible for a third-party platform’s availability, behaviour, fees, moderation decisions, account suspensions, rate limits, data practices, or feature changes. We may modify or discontinue an integration when a platform changes its API, developer programme, or terms.

9. AI-assisted features

The Service may offer features that generate text, images, video, captions, hashtags, summaries, or analytics (“AI Output”). AI Output may be inaccurate, incomplete, biased, or unsuitable. You are solely responsible for reviewing it before publication, checking rights and accuracy, and complying with applicable law and platform rules.

To provide AI features, we may transmit prompts and selected inputs to third-party model providers. Our handling of those inputs is described in the applicable privacy disclosures and provider terms.

10. Intellectual property

The Service, Site, software, designs, text, graphics, logos, trademarks, and other materials made available by Open Growth Group or its licensors—excluding Your Content and components governed by their own open-source licences—belong to Open Growth Group or the relevant licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.

Open-source components remain governed by the licences distributed with them. Nothing in these Terms limits rights granted under those licences.

11. Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Open Growth Group a perpetual, irrevocable, worldwide, royalty-free right to use them for any purpose without obligation or compensation.

12. Privacy and data protection

Our processing of personal data in connection with the Service is described in our Privacy Policy, which forms part of these Terms. Where we process personal data on your behalf, additional data-processing terms may apply.

You are responsible for providing any notices and obtaining any permissions required for the content and personal data you submit to the Service or publish through a connected platform.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, fail to pay amounts due, create legal or security risk, misuse a connected platform, or where required by law.

After termination, your right to access the Service ends. We may delete Your Content and account data after a reasonable retention period as described in our privacy disclosures. Provisions that should survive by their nature—including content licences, intellectual property, accrued fees, disclaimers, liability limits, indemnification, and dispute terms—survive termination.

14. Disclaimers

To the maximum extent permitted by law, the Service and Site are provided “as is” and “as available”, without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that scheduled posts will always be delivered on time, that connected platforms will accept them, or that third-party analytics will be accurate or complete. You remain responsible for reviewing and approving content before publication.

15. Limitation of liability

To the maximum extent permitted by law, Open Growth Group INC and its affiliates, officers, directors, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising from or related to these Terms, the Site, or the Service.

Our aggregate liability arising from or related to these Terms or the Service will not exceed the greater of (a) the fees you actually paid to Open Growth Group INC for the Service in the twelve months before the event giving rise to the claim, or (b) USD 100.

16. Indemnification

You agree to indemnify, defend, and hold harmless Open Growth Group INC and its affiliates, officers, directors, employees, agents, and licensors from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to Your Content, your use of the Service, your breach of these Terms, your violation of applicable law or third-party rights, or a dispute between you and a third party related to content published through the Service.

17. Communications

If you opt in to product, promotional, or educational communications, you may unsubscribe using the link in those messages. Transactional and account-related messages—including security alerts and service notices—remain necessary while your account is active.

18. Cookies

We may use cookies and similar technologies for authentication, preferences, security, analytics, and other Service functions. Their use is described in our privacy disclosures and any controls presented on the Site.

19. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will provide reasonable notice by email, in-product notice, or another appropriate channel. Changes take effect on the date stated at the top of the updated Terms. Continued use after that date constitutes acceptance.

20. Governing law and disputes

These Terms and related non-contractual obligations are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts located in Delaware have exclusive jurisdiction over disputes arising from or related to these Terms or the Service, except that either party may seek urgent injunctive relief in a court with appropriate jurisdiction.

Nothing in this section limits non-waivable consumer rights available under the mandatory law of your place of residence.

21. General

These Terms, together with any privacy policy, data-processing terms, order form, or plan-specific terms that you accept, constitute the entire agreement between you and Open Growth Group INC about the Service. If a provision is held invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
